Official Rules

No purchase or payment of any kind is necessary to participate in this campaign or be selected for the Elementary Library Makeover or receipt of the School Supply Crate.  

Void Where Prohibited. The selected schools may be required to execute Library Makeover or School Supply Crate acceptance documents, including liability, publicity, photo and video releases, and return them within ten (10) days of selection notification, as detailed below.  

Please read these Official Rules carefully before nominating.

Terms

The Heart of America Foundation® (“HOA”) Scott Brothers Elementary School Library Makeover Campaign (“Campaign”), begins at 12:00 AM U.S. Eastern Time (“ET”) on October 2, 2018 and ends at 11:59 PM ET on October 31, 2018. Information on how to nominate a school, receive an Elementary School Library Makeover or a School Supply Crate is described below and form part of these official rules (“Official Rules”). By submitting a nomination, each nominator (“Nominator”) agrees to these Official Rules and warrants that its entry complies with all requirements set out in the Official Rules.

Who May Nominate

The Elementary School Library Makeover Campaign is open to elementary public schools, serving levels kindergarten through grade 6, located in the continental United States of America (including Washington, DC.) Schools located in Hawaii, Alaska, U.S. territories or otherwise outside the United States are not eligible. Individuals nominating a school must be twenty-one (21) years of age or older. This Elementary School Library Makeover Campaign is subject to all applicable federal, state, and local laws and regulations. Participation constitutes Nominator’s full and unconditional agreement to these Official Rules and HOA’s decisions, which are final and binding in all matters related to the Campaign. Receiving a Library Makeover or School Supply Crate is contingent upon fulfilling all requirements set forth herein.

1. How to Nominate

To nominate a school, visit www.heartofamerica.org/nominations to complete a nomination form with the required information, including your name, address, telephone number, e-mail address, and other requested information, agree to these Official Rules and submit your nomination in accordance with the instructions thereon.

Multiple entries by the same Nominator are allowed, but each individual is permitted to submit only one entry per calendar day.  

All entries must be submitted and received by 11:59 PM ET on October 31, 2018. Odds of being selected depend on the number of eligible nominations received. HOA is unable to estimate the projected number of nominations. 

2. Selection of Makeover School

HOA and Scott Brothers Global LLC (“Scott Brothers Global”) will select up to three (3) finalists from all eligible nominations to complete and submit an HOA Elementary School Library Makeover application, to include CAD/DWG files of the school library space and environmental reports for the library makeover. HOA may visit the finalist schools for further evaluation. HOA will select the final school for the HOA School Library Makeover by November 14, 2018, and notify the selected school promptly thereafter. HOA may select the Library Makeover school, and make all other decisions regarding the campaign, based on criteria determined by it in its sole discretion. HOA and Scott Brothers Global will also select thirty (30) runner-up nominee schools, based on criteria determined by HOA in its sole discretion to receive School Supply Crates described below.

3. Elementary School Library Makeover and School Supply Crates

The selected Library Makeover school will be eligible, subject to execution of applicable documentation provided by HOA, to receive an HOA school library makeover in 2019 with an estimated value of $100,000. The thirty (30) runner-up nominee schools will receive, subject to execution of applicable documentation provided by HOA, a School Supply Crate with an estimated value of $1250, including a HarperCollins book collection. 

No Library Makeover transfer, assignment, or substitution by the selected schools is permitted. If a School Supply Crate (or part of the School Supply Crate) is unavailable, then HOA, in its sole discretion, reserves the right to substitute the School Supply Crate (or that part of the School Supply Crate) with an alternative gift to the equal monetary value and/or specification, unless to do so would be prohibited by law. NONCOMPLIANCE OR RETURN OF SCHOOL SUPPLY CRATE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY EMAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATE POTENTIAL WINNER.

Decisions of HOA are final and binding. HOA is not responsible for any incorrect or inaccurate information or any lost or misdirected entries. School Library Makeover and School Supply Crate details are at HOA’s discretion. Nominations become the property of HOA. Personal data submitted through HOA’s website will be used in accordance with HOA’s privacy policy.

4. Limitation of Liability and Indemnification

By entering this Elementary School Library Makeover Campaign, all Nominators agree to release, discharge, indemnify and hold harmless HOA, Scott Brothers Global and their respective partners, affiliates, agents and their employees, officers, directors, and representatives (the “HOA Indemnified Parties”) from any claims, losses, and damages arising out of their participation in this Campaign or any Campaign-related activities and the acceptance and use, misuse, or possession of the School Library Makeover or School Supply Crate hereunder.

HOA  and Scott Brothers Global assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to nominations or nomination forms; or alteration of nominations or nomination forms. HOA and Scott Brothers Global are not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any nomination to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials related to in this Campaign.

In no event shall any HOA Indemnified Party be liable for indirect, special, incidental or consequential damages of any kind in connection with or arising out of the Campaign or Official Rules (whether in contract, tort, negligence, strict liability, statute or otherwise) even if such party has been advised, knew or should have known of the possibility of such damages, including, but not limited to, lost profits or cost of capital. In no event shall the HOA Indemnified Parties’ cumulative liability exceed one dollar ($1.00). The provisions of this section shall survive the expiration of the Campaign and shall apply even if the limited remedy specified in these Official Rules is found to have failed of its essential purpose.
By entering this Campaign, you hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents.  

5. Other Conditions

THIS CAMPAIGN IS VOID WHERE PROHIBITED. Nominators agree that these Official Rules shall be subject to and governed by and subject to the laws of the state of Maryland and the forum for any dispute shall be in the state of Maryland, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or on connection with this Campaign are hereby excluded and any nominator expressly waives any and all such rights. Certain restrictions may apply. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Campaign materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control.

By entering and clicking “I Agree to the Official Rules” upon submission of a Nomination, Nominators also agree (a) to be bound by these Official Rules; and (b) that the decisions of HOA are final and binding with respect to all matters relating to the Campaign. All federal, state and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on the School Library Makeover or School Supply Crate are the sole responsibility of the recipients. In the event that the selected school(s) is/are ineligible, cannot reasonably be located or reached after reasonable attempts (within the sole discretion of HOA) or does/do not respond within ten (10) days to a selection notification, or refuses the School Library Makeover or School Supply Crate, the gift will be forfeited and HOA, in its sole discretion, may choose whether to award the School Library Makeover or School Supply Crate to another entrant.

HOA reserves the right to verify the validity of any Nomination and/or Nominator (including a Nominee’s identity and address) and to disqualify any Nominator who submits a Nomination that is not in accordance with these Official Rules or who tampers with the nomination process. Failure by HOA to enforce any of its rights at any stage does not constitute a waiver of those rights.

6. Right to Cancel or Suspend Campaign

If for any reason the Campaign is not capable of running as planned, due to infection by computer virus, bugs, worms, Trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of HOA that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Campaign, HOA reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the nomination process, and/or to cancel, terminate, modify, or suspend the Campaign.

7. Selected School List

Nominators are responsible for complying with these Official Rules. Names of the schools selected for the Elementary Library Makeover and School Supply Crates will be available online at www.heartofamerica.org on or after November 14, 2018.

8. Data Privacy

By submitting a Nomination, Nominators agree that HOA may post their names on its website or other promotional materials and that it may publicize information about schools selected for the Elementary Library Makeover and School Supply Crates as described above. All personal data will be used as per the terms and conditions of HOA’s privacy policy, as in effect from time to time.
